TogiFitness 60-Day Challenge
A purchase will not increase your chances of winning. This is a skill-based contest — winners are determined by judging on merit, not by chance. By entering, you agree to be bound by these Rules. If you do not agree, do not enter.
01Sponsor
TogiGurd LLC, 3349 NW 84th Ct, Doral FL, 33122. The Contest is in no way sponsored, endorsed, administered by, or associated with Instagram, TikTok, Meta Platforms, Inc., or ByteDance Ltd.
02Eligibility
Open to legal U.S. residents (50 states + D.C.), excluding New York, Florida, and Rhode Island, who are 18 or older at the time of entry. Sponsor's employees, contractors, and their immediate family/household are not eligible. By entering, each entrant represents that they are medically able to safely participate in a 60-day fitness program and have consulted a physician if in any doubt. Void where prohibited.
03Contest Period
Begins 06/24/2026 12:00pm CST; ends 08/23/2026 12:00pm CST. Qualifying posts must be made within this period. Sponsor's clock controls.
04How to Enter
To enter, post your progress publicly on Instagram or TikTok tagged #TogiFitnessThing during the Contest Period; your account must be public so the post can be reviewed. Posting an entry constitutes your agreement to these Official Rules, including the Assumption of Risk and Release (§9) and the Publicity and Content License (§10). No sign-up, fee, or purchase is required. Entrants should keep their own records of their posts; Sponsor is not responsible for entries it cannot verify.
05Judging and Winner Selection
At the end of the Contest Period, a panel of three judges designated by the Sponsor will review eligible entries and select the winner on merit, based on the entrant's:
(a) consistency and completeness of documented daily progress under #TogiFitnessThing;
(b) measurable improvement from the entrant's own starting point, within the safe limits in §8; and
(c) demonstrated adherence to a sound, sustainable program.
The judges weigh these factors using the Sponsor's internal evaluation method. The winner is the entrant who, in the judges' reasonable judgment, best meets these criteria. Winners are not selected at random. In the event of a tie, the earliest qualifying entry wins. The judges' decisions are final and binding.
Each entrant's starting point is established by their first dated qualifying post under #TogiFitnessThing, and improvement is measured from that point. Before the prize is paid, the potential winner must provide reasonable verification of their starting and ending condition as requested by the Sponsor.
06Prize
One Grand Prize: $100,000.00, paid by [method]. No substitution or cash equivalent except at Sponsor's discretion. The winner is solely responsible for all taxes; the prize is reported to the IRS and the winner is issued a Form 1099. The winner must return a completed W-9 and valid ID before payment.
07Winner Verification and Medical Clearance
Selection as the potential winner is contingent on verification. Within 10 days of notification, the potential winner must:
• respond to the Sponsor;
• verify their identity and that their posted entries are authentic and their own;
• provide verification of their starting and ending condition for §5 scoring;
• sign a Winner's Affidavit of Eligibility, Liability Release, and (where lawful) Publicity Release;
• provide written medical clearance from a licensed physician dated within the verification window; and
• return a W-9.
If the potential winner cannot be contacted, fails to respond in time, declines, cannot verify entries, cannot provide medical clearance, is ineligible, or has violated these Rules, the prize is forfeited and the Sponsor may select the next-highest-scoring eligible entrant by the same criteria.
08Health, Safety & Prohibited Conduct
Entrant health and safety is a condition of entry. Strictly prohibited, with immediate disqualification: diuretics, laxatives for weight manipulation, anabolic steroids or other banned substances, deliberate extreme dehydration, and any conduct a reasonable person would recognize as endangering the entrant's health. Sponsor may require check-ins and may disqualify any entrant whose methods or condition raise a reasonable safety concern. Sponsor guarantees no health outcome and makes no representation that participation is safe for any individual; entrants participate at their own risk and should consult a physician first.
09Assumption of Risk & Release
By entering (which, under §4, occurs upon posting a qualifying entry), each entrant acknowledges that participation in a fitness program carries inherent risks, including physical injury, and voluntarily assumes all such risks. To the fullest extent permitted by law, each entrant releases and holds harmless the Sponsor and its owners, officers, employees, agents, judges, and representatives from all claims, injuries, losses, or damages arising from participation, training, conduct, or prize use. This release does not apply where prohibited by law.
10Publicity & Content License
Except where prohibited by law, by entering each entrant grants Sponsor an irrevocable, royalty-free, worldwide license to use the entrant's name, likeness, handle, statements, and submitted content for advertising and promotion relating to the Contest, without further notice, compensation, or consent.
11Platform Compliance
Entrants must follow Instagram's and TikTok's terms and community guidelines; posts must not infringe third-party rights or contain unlawful or inappropriate content. This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram or TikTok, and each entrant releases those platforms from all responsibility for this Contest.
12General Conditions
Sponsor may disqualify tampering, rule violations, or disruptive conduct. If the Contest can't run as planned (fraud, technical failure, causes beyond Sponsor's control), Sponsor may modify, suspend, or terminate it and select winners from eligible entries to that point, as permitted by law. These Rules cannot change after the Contest begins except as required by law or to clarify an ambiguity.
13Governing Law, Arbitration & Class-Action Waiver
These Rules are governed by the laws of the State of Texas, without regard to conflict-of-laws principles.
Binding Arbitration
Except as carved out below, any dispute, claim, or controversy arising out of or relating to the Contest or these Rules — including its existence, breach, interpretation, or validity — shall be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration shall be seated in Travis County, Texas, and judgment on the award may be entered in any court of competent jurisdiction. The arbitrator has exclusive authority to resolve any dispute about the scope or enforceability of this arbitration agreement.
Class-Action Waiver
All disputes shall be arbitrated on an individual basis only. Each entrant waives any right to bring or participate in a class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding. If this class-action waiver is found unenforceable, then the entire arbitration provision shall be void, but the rest of these Rules remain in effect.
Exceptions
Either party may (a) bring an individual claim in a small-claims court for disputes within that court's jurisdiction, and (b) seek injunctive or equitable relief in the state or federal courts located in Travis County, Texas, to protect intellectual property or confidential information. Nothing in this section limits the Sponsor's right to disqualify entrants under these Rules.
Opt-Out
An entrant may opt out of this arbitration agreement by sending written notice to contest@togi.us within 30 days of first entering, stating their name and intent to opt out. Opting out does not affect any other part of these Rules.
14Winner List
For the name of the winner, send a written request to contest@togi.us within 60 days after the Contest ends.
